Call of Duty Lawsuit Reportedly Settled Out of Court

Activision will not disclose settlement details

Remember how a few weeks ago we reported that Activision paid West and Zampella $42 Million? Remember how I said the trial was going to take place anyway?

Yeah… about that…

Apparently it’s all over, and Activision has settled with their former employees Jason West and Vince Zampella out of court.  Additionally, Activision is not releasing any of the details of the settlement, leaving those who were following the case wondering just how much the payout was.  The only information released by Activision was the following statement:

“The company does not believe that the incremental one-time charges related to the settlement will result in a material impact on its GAAP or non-GAAP earnings per share outlook for the current quarter or the calendar year, due to stronger-than-expected operating performance in the current quarter."

In other words, we won’t be able to find anything out by examining information released to their investors.

Activision reported early on that they set aside one billion dollars to fund and deal with any potential fallout from the case, as well as make any necessary payments.  Taking that money out of circulation early likely helped them keep the actual settlements from impacting any publically accessible financial documents.

Suffice to say, the case which had the potential to be the video game trial of the decade ended much the way TS Eliot said the world will, "not with a bang, but a whimper."

Wouldn't be surprised if that undisclosed settlement was at least half of what West and Zampella were asking for.

Maybe Activision didn't want to drag this out, scaring off investors?
